Public offer for the provision of services for organising and holding competitions

Version of 1 September 2026. Payment of the entry fee means full and unconditional acceptance of all the terms of this offer. The terms of a specific competition (dates, fee amount, currency, categories, prizes) are set out in the Regulations of that competition.

1. General provisions and terms

1.1. This document is a public offer of DEMUSIC.ONLINE LLP (hereinafter the Organiser): a proposal to any legally capable person, as well as to the legal representative of a minor, to conclude an agreement for the provision of services for organising and holding a competition whose information is published on the Website (hereinafter the Competition) on the terms below (Articles 395 and 396 of the Civil Code of the Republic of Kazakhstan).

1.2. Terms:

  • Organiser — DEMUSIC.ONLINE LLP, BIN 230140040554.
  • Participant — a performer, group or other person on whose behalf an Application is submitted. On behalf of a minor Participant the agreement is concluded by their Legal Representative — a parent, adoptive parent, guardian or custodian.
  • Competition — a performance competition or other competition held by the Organiser, as a rule remotely, according to the Regulations.
  • Regulations — a document approved by the Organiser for a specific Competition and published on that Competition's page on the Website. It sets out: disciplines and age categories, dates, the amount and currency of the Entry Fee, discount terms, requirements for materials and duration, assessment criteria, prizes and awards, the deadline for a full refund of the fee and other terms of the Competition. The Regulations are an integral part of the offer.
  • Website — https://demusic.online/, https://demusicaward.com/, https://pianoaward.com/, https://accordionlights.com/ and their pages, including the pages of individual Competitions.
  • Application — the online form for taking part in a Competition on the Website.
  • Competition Materials — a video, audio or other recording of the performance, a link to it and information about the pieces performed.
  • Entry Fee — payment for the services of organising and holding the Competition (section 5).
  • Jury — a panel of experts that assesses the performances (its members are listed in the Regulations).

1.3. The Competition is a contest of skill. The result is determined by the Jury's assessment according to the criteria in the Regulations, not by chance. The Competition is not a lottery, game or bet.

1.4. The offer applies to every Competition of the Organiser. A separate agreement is concluded for each Competition for which an Application is submitted, on the terms of this offer and the Regulations of that Competition.

3. Subject of the agreement

3.1. The Organiser undertakes to provide the Participant with services for organising and holding the Competition: to receive and check the Application and Competition Materials, to ensure that the performance is assessed by the Jury (or in another way stated in the Regulations), to publish the results and to send an electronic award document. The type of award documents and the cases in which letters of appreciation are sent to teachers are set out in the Regulations.

3.2. The Participant undertakes to pay the Entry Fee and to provide the Competition Materials in accordance with the Regulations and this offer.

3.3. The Entry Fee is payment for organising and holding the Competition: receiving applications, the Jury's work, preparing and issuing award documents and technical support. It is not payment for a prize place, title or cash prize: these depend solely on the Jury's assessment.

4. Participation procedure

4.1. The dates for receiving applications, assessment, publication of results and sending award documents are set out in the Regulations. Unless otherwise stated in the Regulations, Astana time (UTC+5) applies. Results are published on the Website or in another source stated in the Regulations.

4.2. Disciplines, age categories, duration, and requirements for recording and uploading Competition Materials are set out in the Regulations.

4.3. To take part you need to:

  • fill in the online application with accurate data;
  • provide the Competition Materials in the manner set out in the Regulations;
  • pay the Entry Fee and attach proof of payment;
  • confirm acceptance of the offer and give consent to the processing of personal data.

4.4. Performing the actions listed in clause 4.3 constitutes acceptance of the offer. The agreement is concluded when the Entry Fee is credited to the Organiser's bank account.

4.5. Data from the Application appear on the award documents exactly as entered by the Participant. They can be corrected before the assessment begins (the date is given in the Regulations) by writing to the Organiser's email.

4.6. An Application is not admitted to assessment if the Competition Materials do not meet the requirements of the Regulations. Where possible, the Organiser informs the Participant by email and gives time to correct the materials before the application deadline.

5. Fees and payment procedure

5.1. The amount and currency of the Entry Fee are set by the Regulations of the relevant Competition and may differ for different Competitions, disciplines and categories. The fee stated in the Regulations and on the Application page on the date of payment applies.

5.2. The fee is paid per Application, unless the Regulations provide otherwise (for example, the payment procedure for duets and groups). Participation in several disciplines or Competitions requires separate Applications and fees.

5.3. Discounts and reduced fees are granted only if they are provided for by the Regulations, in the manner set out therein. A discount cannot be combined with other promotions and promo codes unless the Regulations provide otherwise.

5.4. Payment is made by bank transfer to the Organiser's account using the details in section 2 (the «Company details» page). Payment reference: «Entry fee, Competition name, Participant's full name». Proof of payment (receipt, payment order, slip) is attached to the Application. Payments to personal accounts and cards of individuals are not accepted.

5.5. The fee is paid in full in the currency stated in the Regulations to the corresponding Organiser's account listed in section 2. Fees of the sending bank and intermediary banks are paid by the payer: the full amount of the fee must be credited to the Organiser's account.

5.6. Payment may be made by a third party (parent, teacher, educational institution). The rights and obligations under the agreement then arise for the Participant (their Legal Representative).

5.7. On request by email, the Organiser sends a confirmation of payment.

6. Refund terms

6.1. Full refund before the set deadline. The Participant may withdraw and receive a full refund of the Entry Fee if a written request reaches the Organiser's email no later than the deadline stated in the Regulations. If no deadline is stated in the Regulations, it is the application deadline.

6.2. After this deadline the fee is not refunded: the materials are prepared for assessment and the performance is assessed, i.e. the service is provided. Exceptions are clauses 6.3 and 6.5.

6.3. The Entry Fee is refunded in full if:

  • the Competition is cancelled or not held through the Organiser's fault;
  • the fee was paid twice or in excess (the excess is refunded);
  • the Organiser refused to admit the Application for reasons not related to a breach of the Regulations by the Participant.

6.4. The Entry Fee is not refunded if:

  • the Participant disagrees with the Jury's decision;
  • the Participant is disqualified for breaching the Regulations (failure to meet material requirements, false age or data, someone else's performance);
  • the materials are not accessible via the Participant's link and were not corrected before the application deadline;
  • the award document was not received because of an incorrect email in the Application.

6.5. If the Competition cannot be held due to force majeure, the Organiser moves it to a new date; if the Participant does not agree with the new date, they may demand a full refund of the fee.

6.6. Timing and method. Refunds are made within 10 working days of receipt of the request to the account from which the payment was made (or to other details provided by the Participant by agreement). In cases of a full refund, bank fees for the refund are paid by the Organiser.

6.7. A refund request is sent to accordionlights@gmail.com with the subject «Fee refund» and the Competition name, and contains the Participant's full name, the date and amount of payment and the refund details. More information is on the «Payment and refund terms» page, which is part of the offer.

6.8. The provisions of this section do not limit consumer rights established by the legislation of the Republic of Kazakhstan.

7. Rights and obligations of the parties

7.1. The Organiser must: hold the Competition within the dates stated in the Regulations; ensure the assessment of performances; publish the results; send electronic award documents; protect personal data; inform about changes via the Website or email.

7.2. The Organiser may: refuse to admit an Application or disqualify a Participant for breaching the Regulations; request documents confirming age and the right to a discount; change the composition of the Jury; use Competition Materials on the terms of section 8.

7.3. The Participant must: provide accurate data; comply with the Regulations' requirements for materials and duration; pay the Entry Fee; keep the materials accessible for the entire Competition period; not infringe third-party rights; confirm that the Legal Representative is entitled to act on behalf of the minor.

7.4. The Participant may: receive information about the course of the Competition; receive an award document; contact the organising committee by email; withdraw on the terms of section 6.

8. Copyright and use of materials

8.1. The rights to the recording and performance remain with the Participant. The Participant guarantees that they are entitled to use the pieces performed and that the performance does not infringe third-party rights. Claims of right holders are settled by the Participant.

8.2. The Participant grants the Organiser a free non-exclusive right to use the Competition Materials for assessment by the Jury, storage during the Competition and the consideration of disputes.

8.3. The Organiser may publish the Participant's materials on the Website, the Organiser's social networks and in advertising materials only with the Participant's separate consent (an optional tick box in the Application). Refusal does not affect participation or assessment; consent may be withdrawn at any time.

8.4. Results (full name, country, age category, title of the piece, score, title awarded) are published as part of the Competition; consent to this is given in the Consent to personal data processing. For minors, consent is given by the Legal Representative.

9. Personal data

9.1. The Organiser processes personal data in accordance with Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 «On Personal Data and Their Protection» and the Privacy Policy published on the Website.

9.2. By submitting an Application, the Participant (for a minor — the Legal Representative) consents to data processing according to the «Consent to personal data processing» form. Data of minors are provided only by the Legal Representative.

9.3. The scope of data, purposes, retention periods and the procedure for withdrawing consent are set out in the Privacy Policy.

10. Liability of the parties

10.1. The parties are liable in accordance with the legislation of the Republic of Kazakhstan and this offer.

10.2. The Organiser's liability for improper provision of services is limited to the amount of the Entry Fee paid, unless the law (including consumer protection legislation) requires otherwise.

10.3. The Organiser is not liable for: the quality of the internet connection and services on the Participant's side; inaccessibility of materials due to cloud storage settings; inaccurate data in the Application; failures of banks and payment systems beyond the Organiser's control; non-delivery of emails due to an incorrect address or spam filters.

10.4. The parties are released from liability for non-performance caused by force majeure (natural disasters, military action, acts of public authorities, mass communication and platform failures, epidemics). The Organiser reports such circumstances on the Website or by email. If they last more than 30 days, the Participant may receive a full refund of the fee.

11. Jury decision and prizes

11.1. Performances are assessed by the Jury members according to the criteria of the Regulations; the procedure for calculating the final score is set out in the Regulations.

11.2. The Jury's decision is final and not subject to appeal or review. Disagreement with the Jury's decision is not grounds for a refund of the Entry Fee.

11.3. The amount of the prize fund (if any), the conditions of its award, and the procedure and timing of payment are set out in the Regulations.

12. Changes to the terms

12.1. The Organiser may change the offer, the Regulations, the dates and format of the Competition and the Jury by publishing the changes on the Website. Changes take effect upon publication unless another date is stated. Changes to the offer do not apply to agreements concluded before their publication, unless otherwise provided by law.

12.2. If the Competition date is postponed by more than 30 days or the terms of participation have significantly worsened, the Participant may, within 7 days of the notice, withdraw and receive a full refund of the fee.

12.3. The Organiser notifies of changes by publication on the Website and by email to the addresses in the Applications.

13. Governing law and dispute resolution

13.1. The agreement is governed by the legislation of the Republic of Kazakhstan.

13.2. Disputes are first settled by negotiation. A claim is sent in writing to the Organiser's email or postal address; a reply is given within 15 working days of receipt.

13.3. If the dispute is not settled, it is considered by the court at the Organiser's location, taking into account the jurisdiction rules established for consumers.

14. Term and termination

14.1. The offer is valid from the date of publication until withdrawn by the Organiser. Agreements concluded before the withdrawal remain in force until the obligations are fully performed.

14.2. The Organiser may terminate the agreement and disqualify a Participant who has breached the Regulations, provided false data, infringed third-party rights or posted unlawful materials. The fee is not refunded in this case, except as provided in clause 6.1.

14.3. The Participant may withdraw from the agreement in accordance with section 6.

15. Final provisions

15.1. The Competition Regulations are an integral part of the offer. For matters specific to the Competition (dates, fee, currency, categories, prizes, requirements for materials), the Regulations apply. In case of a conflict between the offer and the Regulations regarding refunds and personal data, the offer prevails.

15.2. The agreement is concluded electronically; electronic correspondence and documents are legally binding.

15.3. The invalidity of one provision of the offer does not invalidate the rest.
